For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access any of the Services.

  • When you visit our Site, open or click on emails we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies.

How We Use Your Personal Information

  • Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account. We may also enhance your shopping experience by enabling Shopify to match your account with other Shopify services that you may choose to use. In this case, Shopify will process your information as set forth in its Privacy Policy and Consumer Privacy Policy.
  • Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites.
  • Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately..
  • Communicating with You and Service Improvement. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you

Like many websites, we use Cookies on our Site. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We use Cookies to power and improve our Site and our Services (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve and optimize the Services). We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites. Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. We do not use or disclose sensitive personal information without your consent or for the purposes of inferring characteristics about you.

Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

  • Appeal: You may have a right to appeal our decision if we decline to process your request. You can do so by replying directly to our denial.

If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. International Users

Please note that we may transfer, store and process your personal information outside the country you live in. Your personal information is also processed by staff and third party service providers and partners in these countries.

If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

欢迎您使用 HISONG Link。本《HISONG Link 用户协议》（以下简称“本协议”）是您与 HISONG Link 移动应用（以下简称“本应用”）在中国大陆地区的运营者四川传声科技有限公司（以下简称“四川传声”或“我们”）之间，就您下载、安装、使用本应用及相关服务所订立的协议。本应用的品牌、软件与设备固件技术由 HISONG Music Technology Inc. 授权并提供支持。

请您在使用本应用前认真阅读并充分理解本协议，特别是涉及服务限制、用户内容、知识产权、免责或责任限制、争议解决等以加粗方式提示的条款。您主动勾选“我已阅读并同意”并点击“同意并继续”，或下载、安装、启动、使用本应用，即表示您已阅读、理解并同意接受本协议约束。如您不同意本协议，请停止使用本应用。如您为未成年人，请在监护人陪同下阅读本协议，并在取得监护人同意后使用本应用。

特别提示：本应用主要用于 HISONG 音频设备连接与控制、录音/录像、音频处理、作品导出、固件升级和帮助支持。请您依法合规使用本应用，不得未经他人同意录制、传播涉及他人隐私、肖像、个人信息、商业秘密或其他受法律保护的音视频内容，不得利用本应用从事任何违反法律法规或公序良俗的行为。

一、协议主体和适用范围

  1. 本协议适用于本应用及其相关服务。不同系统、设备型号或版本的功能可能存在差异，具体以您实际使用的版本和页面展示为准。
  2. 本协议由四川传声科技有限公司作为运营者与您订立。本应用的品牌与相关软件、固件技术由 HISONG Music Technology Inc. 授权提供。
  3. 本协议与《HISONG Link 隐私政策》共同构成您使用本应用的完整约定。如您通过应用商店、设备说明书、官方网站或其他渠道看到与本协议相关的补充说明、功能规则、活动规则，该等规则与本协议具有同等效力；若存在冲突，以发布时间较新的规则为准，但法律法规另有规定的除外。

二、服务内容

本应用可能向您提供以下功能，具体以实际版本为准：

  1. HISONG 设备发现、配对、连接、状态展示、电量展示和设备参数控制。
  2. 通过手机麦克风、USB 音频设备、蓝牙音频路由等方式进行录音、监听、音频处理、混音、导出和分享。
  3. 相机预览、视频录制、带音频的视频内容创作和本地保存。
  4. 导入本地伴奏或音频文件，进行播放、编辑、保存和导出。
  5. HISONG 设备固件版本检查、固件下载、升级安装、升级结果展示和故障排查。
  6. 帮助文档、邮件客服、问题反馈、本地日志导出等支持服务。
  7. 统计分析和崩溃诊断，用于提升产品稳定性和使用体验，具体以《隐私政策》为准。

我们可能根据业务发展、技术升级、合规要求、设备适配或安全原因，对功能进行新增、调整、暂停或终止，并在必要时通过应用内提示、版本更新说明或其他合理方式通知您。

三、使用条件和未成年人使用

  1. 您应具备与使用本应用相适应的民事行为能力。若您不具备完全民事行为能力，请在监护人同意和指导下使用本应用，相关民事法律行为由监护人依法追认或代理。
  2. 本应用不专门面向未成年人。未成年人使用录音、录像、分享、固件升级等功能时，应取得监护人同意，并遵守法律法规、学校或家庭管理要求。监护人应履行监护职责，指导未成年人合理使用本应用、保护个人信息安全。
  3. 您应自行准备使用本应用所需的手机、操作系统、网络连接、HISONG 设备、USB 线缆、蓝牙或其他硬件条件，并承担由此产生的费用。

四、账号说明

本应用当前不提供应用内账号注册或登录功能。因此，您无需注册账号即可使用本应用主要功能，也不存在应用内账号注销流程。如未来新增账号体系，我们将另行提供账号注册、登录、注销、信息管理和安全保护规则，并依法征得您的同意。

五、授权许可和使用限制

  1. 在您遵守本协议的前提下，我们授予您一项个人的、有限的、不可转让、不可再许可、非独占的许可，用于在您合法拥有或控制的移动设备上安装和使用本应用。
  2. 您不得对本应用进行反向工程、反向编译、反汇编、破解、篡改、绕过技术限制、删除权利声明，或以其他方式获取源代码，但法律法规明确允许的除外。
  3. 您不得利用本应用从事危害国家安全、荣誉和利益，煽动分裂国家、破坏国家统一，宣扬恐怖主义、极端主义、民族仇恨，传播暴力、淫秽色情、虚假或违法信息，损害社会公共利益或他人合法权益，以及其他违反法律法规的行为。
  4. 您不得通过本应用传播违法、有害、侵权、骚扰、欺诈、恶意软件、垃圾信息或其他不当内容，不得干扰、破坏本应用或相关服务器和网络的正常运行。
  5. 您不得以商业转售、出租、出借、托管、服务外包等方式向第三方提供本应用或相关服务，除非取得我们的书面许可。

六、用户内容和知识产权

  1. 您使用本应用录制、导入、编辑、导出、分享的音频、视频、图片、文件、文字、日志等内容（以下简称“用户内容”），除法律法规另有规定或双方另有约定外，其权利归属由内容本身的权利状态决定。您不会因使用本应用而转让您对合法内容享有的权利。
  2. 您应确保您录制、导入、编辑、导出或分享的用户内容来源合法，并已取得必要授权，包括但不限于音乐作品、录音制品、伴奏、表演、肖像、声音、商标、文字、图片、视频素材等相关权利。
  3. 如您将作品分享到第三方平台或提供给他人，您应自行遵守该平台规则和相关法律法规，并自行承担由内容使用、传播或授权不足引发的责任。
  4. 未经他人同意，您不得录制、披露或传播涉及他人隐私、个人信息、肖像、商业秘密、未成年人权益或其他受法律保护的信息。
  5. HISONG、本应用、界面设计、软件代码、文档、图标、商标、服务名称、设备固件和相关技术资料的知识产权归 HISONG Music Technology Inc. 或相应权利人所有。未经许可，您不得复制、修改、传播、出售、许可或用于其他商业目的。

七、设备连接、录音录像和固件升级注意事项

  1. 使用蓝牙、USB、麦克风、相机、媒体文件、通知、前台服务等功能时，本应用可能需要调用系统权限。您可以在系统设置中管理权限，关闭权限可能导致相关功能不可用。权限的使用目的详见《隐私政策》。
  2. 录音、录像、监听、音频处理和导出结果受设备型号、操作系统、外接设备、环境噪声、采样率、存储空间、电量、线缆、蓝牙连接质量等因素影响。请您在重要录制前进行测试，并自行备份重要文件。
  3. 固件升级过程中，请保持设备电量充足、连接稳定，不要强制退出应用、断开设备、拔出接收器或关闭电源。因未按提示操作、设备异常、网络中断、电量不足、使用非官方固件或不可抗力导致升级失败或设备异常的，您应按照应用提示或联系客服处理。
  4. 本应用提供的音频效果、降噪、混响、压缩、EQ、监听等功能仅作为创作和设备控制工具，不构成专业录音、医疗、听力保护或安全保障承诺。长时间高音量监听可能损害听力，请合理控制音量和使用时长。

八、费用和第三方费用

  1. 本应用当前基础功能免费提供。如未来推出收费功能、订阅、增值服务或付费内容，我们会在您购买或开通前明确展示价格、服务内容、期限、退订方式等信息，并依法取得您的确认。
  2. 您使用本应用过程中产生的网络流量费、短信费、应用商店费用、设备购买或维修费用、第三方平台费用等，由相关服务提供方收取并由您自行承担。

九、隐私和个人信息保护

我们重视您的个人信息保护。我们将按照《HISONG Link 隐私政策》收集、使用、存储、共享和保护您的个人信息。请您在使用本应用前仔细阅读并理解该政策。您使用本应用，即表示您同意我们按照该政策处理您的个人信息；依法需要单独同意的场景（如处理敏感个人信息、向第三方或境外提供个人信息），我们会另行取得您的单独同意。

十、服务变更、中断和终止

  1. 我们可能因版本更新、系统维护、设备适配、服务器调整、网络故障、安全风险、法律法规或监管要求等原因，临时中断、限制或调整部分服务。
  2. 如您违反本协议或法律法规，我们有权根据具体情况采取提示整改、限制功能、暂停服务、终止服务、保存相关记录、向有关主管部门报告等措施。
  3. 您可以随时停止使用并卸载本应用。卸载后，本地文件是否删除取决于系统规则和您保存文件的位置，请您自行确认并备份重要内容。

十一、免责声明和责任限制

  1. 我们将依法采取合理措施保障服务稳定和安全，但在法律允许范围内，不承诺本应用在所有设备、系统版本、网络环境或外接设备上均无错误、不中断或完全满足您的特定需求。
  2. 因您违反法律法规、本协议、设备说明或应用提示，或因您提供的内容、授权不足、分享行为、第三方平台规则、第三方服务故障导致的损失或争议，由您自行承担责任。
  3. 对因不可抗力、基础运营商故障、应用商店政策、操作系统限制、第三方服务异常、网络攻击、政府行为、司法或监管要求等非我们可合理控制原因造成的服务中断或损失，我们将在法律允许范围内不承担责任，但会尽力减少影响。
  4. 在法律允许的范围内，我们对您的间接损失、预期利益损失、数据丢失、业务中断、第三方索赔等不承担责任；法律法规另有强制规定的，从其规定，本条不排除或限制依法不能排除或限制的责任。

十二、协议更新

我们可能因业务功能、法律法规、监管要求或产品调整更新本协议。更新后，我们会在本应用或官方网站发布更新版本，并更新发布日期、生效日期和版本号。若更新内容会实质影响您的权利义务，我们会通过弹窗、站内提示或其他显著方式提示您阅读。您继续使用本应用，即表示您接受更新后的协议；如您不同意，请停止使用本应用。

十三、法律适用和争议解决

本协议的订立、履行、解释和争议解决适用中华人民共和国法律（不含冲突规范），法律法规另有强制规定的除外。因本协议或本应用服务产生的争议，双方应先友好协商解决；协商不成的，任何一方均可依法向有管辖权的人民法院提起诉讼。
